What caused the hasty dismissal of the Diddy and Jay Z lawsuit? It seemed like a battle of legal heavy weights. A Mohamed Ali vs. George Foreman like rumble in the concrete jungle. Tony Buzbee was in one corner threatening to bring Hollywood heavy hitters to their knees. Alex Spiro stood opposite, with his hip hop mogul client Jay Z, taunting Buzbee. Under the orders of Judge Annalisa Torres, it seemed, they were in for the long haul.

The hype was just like the 1974 Rumble in the Jungle in Kinshasa, Zaire. Tony Buzbee emerged promising to throw 120 punches in a jiffy, that would knock the wind out of Hollywood stars. He seemed in command until he faced off with Spiro’s, hip hop, rope-a-dope client, Shawn “Jay Z” Carter. On this occasion, Jay Z wasn’t just spitting bars. He was jabbing and counterpunching.

Jay Z landed a psychological blow very early. He called Tony Buzbee an ambulance chaser in a cheap suit – a slur on a lawyer. “My wife and I will have to sit our children down … and explain the cruelty and greed of people”, Jay Z said about the Diddy lawsuit Tony Buzbee included in.

Buzbee took the hit on the chin and went toe-to-toe. “Our conduct has been beyond reproach and will continue to be,” he countered. Thereafter, anticipation of an unprecedented slugfest soared, and the public was tuned in.

Alex Spiro proceeded with lightning speed, trying to make light work of Tony Buzbee. He filed a motion to dismiss the case on a super expedited track. This drew rebuke from Judge Torres, but Spiro stuck to the instruction he mostly likely received from his client – end this ASAP.

How the Diddy and Jay Z Lawsuit Unraveled

A flurry of activity in January 2025 and the early days of February ended the Diddy and Jay Z lawsuit. It started on January 2, when Judge Torres gave Alex Spiro the go-ahead to file a motion to dismiss. Spiro responded swiftly, filing a Rule 11 motion to dismiss the case and sanction Tony Buzbee and his firm.

Rule 11 motions are requests for a federal court to sanction attorneys or parties for frivolous pleadings. Spiro’s contention is that Buzbee filed a frivolous case that never should have seen the light of day. Jay Z’s legal team aggressively chiseled away at cracks in the case Jane Doe’s case accusing him of sexual assault, arguing that key factual claims in the plaintiff’s lawsuit are demonstrably false.

Buzbee filed his opposition to the Motion for sanctions and dismissal on January 22, 2025. It seemed, the stage was now set for a thrilling bout between Spiro and Buzbee, but Judge Torres issued a citation to Tony Buzbee. On January 28, 2025, she directed him to provide proof that is he admitted to practice law in the Southern District of New York.

Buzbee signed the Jane Doe complaint that was filed in the Southern District of New York on October 20, 2024. An attorney who is not admitted to practice in the court generally cannot sign level documents.

An attorney who is not admitted to practice before a particular court may seek pro hac vice admission that allow the attorney to litigate a specific case. The attorney should obtain admission before filing papers and appearing before the court or at least the application for admission should be filed simultaneously.

Eager to make good on his promise to hold Hollywood stars and prominent companies accountable, Tony Buzbee signed and filed the sexual assault complaint while it appears, he was not admitted to the bar of the Southern District of New York. Judge Torres’ order on January 28, gave him up to February 14, 2025, to provide proof that he is admitted to practice before the court.

Tony Buzbee Against the Ropes

As Judge Torres’ February 14 deadlines drew near Tony Buzbee found himself on wobbly legs against the ropes. As the clock ticked, a flurry of behind-the-scenes negotiations took place.

Bad Boy Records LLC, an entity controlled by Sean “Diddy” Combs, struck the first deal on February 7, 2025, to dismiss the complaint against it. Though, Spiro withdrew the Rule 11 motion for sanctions against Buzbee and his firm on January 4, 2025, he filed a Rule 12 motion to dismiss on the same day.

Bad Boy Records LLC, an entity controlled by Sean “Diddy” Combs, struck the first deal on February 7, 2025, to dismiss the complaint against it. Though, Spiro withdrew the Rule 11 motion for sanctions against Buzbee and his firm on January 4, 2025, he filed a Rule 12 motion to dismiss on the same day.

Through the Rule 11 motion Spiro went directly after Buzbee and his law firm. Tony Buzbee signed the initial complaint in October 2024 and a subsequent amended complaint in December 2024. By switching to a Rue 12 motion, Spiro withdrew his focus on punishing Buzbee and merely asked for the case against his client to be dismissed.

On February 14, 2025, the day the deadline for Buzbee to provide proof to the court of his admission to practice law in the Southern District of NY expired, Buzbee filed a request for the case to be dismissed against all the defendants.

There is no sign in the court docket that Tony Buzbee complied with Judge Torres’ order to file proof of his admission to practice in the Southern District of New York. The deadline for him to do so has expired. Nevertheless, Judge Torres approved the dismissal on February 18, 2025, and the case is now closed.
